A motorcyclist from Windmill Hill in Bedminster is warning others
-
A motorcyclist from Windmill Hill, Bedminster, is cleared of speeding as court questions accuracy of camera equipment
charged with speeding on Bristol’s Portway on April 22 last year that their
convictions might not be safe.
Magistrates at his trial in Taunton found Mark Lindsay not
guilty of the speeding offence and called into question the accuracy of the
speed enforcement officer’s equipment.
Mr Lindsay successfully argued that the laser and camera
used by officer Clive Walsh were not properly aligned, resulting in a ticket
being issued to him for a speeding offence committed by a vehicle in front of
his bike.
Mr Lindsay, who commutes from his home in Cotswold Road to work
in Cardiff, was so certain that he hadn’t been speeding that day that he
decided to contest the allegation.
He demanded photographic evidence and when it arrived it
showed Mr Lindsay on his motorbike in the inside lane being overtaken by a car
that was directly in line with his bike but ahead of him in the outside lane.
Video and speed measurement expert Tim Farrow told the court
he thought that the laser had clocked the speed of the nearby car, but the
video camera registered Mr Lindsay’s details for the fine.
Were you caught?
Twenty other people were convicted following the speed
enforcement exercise on the Portway that morning. If you think you may have
been one of them, you can contact Mr Farrow on 01726 63755.

I do object to a picture of some random motorcyclist wearing jeans and trainers being posted as me! Yes, if I hadn't been absolutely positive that I hadn't been speeding, I would have just assumed that the camera was right. Even so, there was a lot of pressure on me to just take the penalty. It would have cost me a lot of money if I'd lost.

ReportI suspect that if more people had the time and energy to argue their case in court we'd see a lot more cases thrown out on these grounds.
